Terms of use

"transferly.swiss" (hereinafter referred to as "the Service") respects the rights of others and requires the same from its users. These terms of use define prohibited and tolerated behavior or content for the use of the Service. If the Service suspects that you, as a user of the Service, may be violating these terms of use, the Service reserves the right to take necessary measures or actions to prevent violations in the short, medium, and long term. These terms of use may be regularly adjusted and modified.

1. Access and Use of the Service

  1. In general, by using the services offered by the Service, a user agrees to strictly comply with the terms of use.
  2. For extended use of the Service, registration is required, in which a user commits to:
    1. Providing correct, up-to-date, and complete personal data.
    2. Regularly reviewing and keeping this data up-to-date.
  3. We reserve the right to periodically review your data for completeness and accuracy.

2. Restrictions

  1. A user must have reached the age of 18 to use this service.
  2. A user may not have more than one free account. It is not allowed to have multiple accounts to obtain more storage space.
  3. Free accounts may only be used for personal purposes.
  4. For commercial use of the service, paid accounts (such as Pro and Enterprise) must be registered.

3. Terms of Use

  1. As a condition of using the service, the user agrees not to upload or share data that:
    1. show child pornography;
    2. are obscene, defamatory, slanderous, profane, offensive, or illegal;
    3. promote racism, violence, or hatred;
    4. are factually inaccurate, false, misleading, or deceptive;
    5. the user does not have the right to copy and/or transmit;
    6. infringe, violate, or abuse intellectual property rights, privacy rights, including data protection laws, and/or other types of rights;
    7. violate applicable laws or regulations;
    8. constitute "hate speech," regardless of whether they are directed at an individual or group and regardless of whether they are based on that person or group's race, gender, faith, national origin, religious affiliation, sexual orientation, or language;
    9. facilitate or promote gambling or the sale or consumption of alcohol, tobacco products, or illegal drugs; and/or
    10. otherwise violate applicable laws.
  2. The user also agrees not to misuse the service. Among other things, the user agrees to refrain from the following actions:
    1. accessing or using the Service in a manner intended to avoid incurring fees, consuming an unreasonable amount of storage space, or exceeding the limitations of your service plan
    2. using unauthorized means to modify, redirect, or access the Service or unauthorized data
    3. accessing the Service with unauthorized software
    4. damaging, disabling, overburdening, or impairing the Service or any associated network
    5. using the Service directly or indirectly to offer a service that competes with the Service
    6. scanning, probing, or testing the vulnerability of any system or network
    7. engaging in or participating in any activity that may interfere with or disrupt the efficiency of the Service
    8. transferring software or data that contains viruses, malware, trojan horses, spyware, or any other malicious software or program code
    9. transmitting chain letters, spam, junk mail, phishing emails, unsolicited promotions, or advertising of any kind and for any purpose.
  3. The user is prohibited from pursuing or engaging in the following actions:
    1. selling, reselling, or renting the services or the software
    2. removing, obscuring, or modifying any indications of transferly.swiss trademarks or other intellectual property appearing on or contained within the services
    3. modifying, copying, manipulating, or creating derivative works of the software or services
    4. analyzing, reverse engineering, disassembling, or decompiling the software or services, or applying any processes or procedures to derive the source code of any software within the services

4. Fair use

  1. The user is expected to use the services in a manner that is consistent with normal and everyday use. Excessive use and burdens on the system will be considered as "unfair" use and will be throttled or blocked by the service accordingly. In the event of repeated occurrences, the service reserves the right to terminate the user and exclude them temporarily or permanently from the service.

5. Abuse

  1. The service aims to provide a serious and secure service. For this reason, users of the service are obliged to report any suspicion or certainty of abuse or violation of the terms of use to the service as soon as possible via email (abuse@transferly.swiss).
  2. If a user suspects unauthorized access to their account, they must immediately change their login information and report this suspicion to the service. In any case, the user remains responsible for the actions taken with their account.
  3. The service reserves the right to analyze incidents with all available data (see privacy policy) if there is suspicion of abuse, whether due to suspicious behavior, abuse reports, or violation of the terms of use, and to respond as it deems appropriate, such as deleting content that is believed to be infringing and blocking or terminating the accounts concerned.

6. Access, Accessing & Data

  1. The user is obliged to protect his access data with the current state of technology and to keep them inaccessible to third parties.
  2. The service does not possess the encryption keys of the individual data transfers and thus cannot access the decrypted data. If a user loses these encryption keys, the unencrypted data cannot be restored. The user cannot hold the service responsible for any potential data loss.
  3. The uploaded and shared data will be automatically deleted by the service after the set time ("expiration"). There are no backups and therefore no possibility of restoration. The user has no claim to any kind of damages.
  1. The service respects the rights of others and expects the same from its users. The service will respond to indications of alleged copyright infringements, if they comply with applicable law and have been provided to it properly.
  2. The service will take all measures that it considers appropriate in its sole discretion, such as deleting content that is allegedly infringing, and blocking or terminating the relevant accounts.
